Welcome to PEPP AI ("the Service"), a web-based platform designed to provide educational quiz and learning content. These Terms of Service ("Terms") govern your use of our website, web application, and all related services (collectively, "the Platform"). By accessing, browsing, or using PEPP AI, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically to stay informed of any updates.

2.1 Eligibility

By using PEPP AI, you represent and warrant that:

• You are at least 18 years of age or have obtained parental/guardian consent
• You have the authority to enter into and be bound by these Terms
• Your use of the Platform is permitted under applicable laws and regulations
• You will comply with all applicable laws and regulations in your jurisdiction

2.2 Account creation

To access certain features of the Platform, you may be required to create an account and provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your password and account information
• Preventing unauthorized use of your account
• Promptly notifying us of any unauthorized access or use
• All activities that occur under your account

We are not responsible for any loss or damage arising from unauthorized use of your account if such loss resulted from your failure to maintain confidentiality.

3.1 Platform overview

PEPP AI provides a freemium platform offering:

• Free tier: Access to up to 3 quizzes per week
• Premium tier: Unlimited quiz access for ₹299 per month

3.2 Service availability

The Platform is provided on an "as-is" and "as-available" basis. While we strive to maintain continuous availability, we do not guarantee uninterrupted or error-free service. We may conduct maintenance, updates, or improvements that may temporarily impact service availability.

3.3 No warranty

PEPP AI makes no warranty, express or implied, regarding the Platform's fitness for any particular purpose, merchantability, or non-infringement. Content provided is for educational purposes only and should not be relied upon as professional advice.

4.1 Free tier

• Limited to 3 quizzes per week
• Resets on a weekly cycle
• Cannot be combined with multiple accounts
• Subject to change at our sole discretion without any prior notice

4.2 Premium subscription

• Provides unlimited quiz access
• Cost: ₹299 per month
• Payment processed through Razorpay or similar platform
• Access begins immediately upon successful payment
• No refund option once payment is processed

4.3 Subscription changes

We reserve the right to change pricing, features, or terms of the Premium subscription with 30 days' written notice. Changes will not affect your current billing cycle.

4.4 Payment processing

All payments are processed securely through Razorpay, our third-party payment partner. By subscribing, you authorize us to charge your chosen payment method. You are responsible for maintaining accurate payment information and for any fees charged by your financial institution.

6.1 User-generated content

You retain ownership of all content you create, upload, or submit to PEPP AI ("User Content"), including quiz answers, notes, responses, and other materials.

By submitting User Content, you grant PEPP AI a worldwide, non-exclusive, royalty-free, perpetual license to:

• Use, display, reproduce, and distribute your User Content solely for Platform operation and improvement
• Analyze User Content to enhance our services and algorithms
• Store User Content for backup and service delivery purposes

6.2 Content rights and restrictions

You represent and warrant that:

• You own or have proper rights to all User Content you submit
• Your User Content does not infringe on any third-party intellectual property rights
• Your User Content does not violate any applicable laws or regulations

You agree not to submit User Content that:

• Violates intellectual property, privacy, or other legal rights of third parties
• Contains malware, viruses, or harmful code
• Is defamatory, obscene, abusive, or harassing
• Promotes illegal activities or violence
• Impersonates any person or entity
• Is spam, unsolicited advertising, or commercial solicitation

6.3 PEPP AI intellectual property

All content, features, functionality, design, text, graphics, logos, and code of PEPP AI are owned by or licensed to PEPP AI and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our express written consent.

You agree to use PEPP AI only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Platform. Prohibited behavior includes:

• Illegal activity: Using the Platform for any illegal purpose or in violation of any local, state, national, or international law
• Harassment and abuse: Harassing, threatening, bullying, or abusing other users or PEPP AI staff
• Unauthorized access: Attempting to gain unauthorized access to the Platform or its systems
• Automated scraping: Using bots, scrapers, or automated tools to extract data from the Platform without authorization
• Commercial misuse of free tier: Using the free tier for commercial purposes or resale of access
• Service disruption: Attempting to disrupt, degrade, or impair the functioning of the Platform
• Fraud: Engaging in fraudulent activity, including false representation of identity or unauthorized use of payment methods
• Data mining: Collecting personal information of other users without consent

Violation of this policy may result in immediate suspension or termination of your account.

You agree to:

• Use the Platform in compliance with all applicable laws and regulations
• Not reverse-engineer, decompile, or attempt to discover the source code or algorithms of the Platform
• Not use the Platform in any manner that could damage, disable, overburden, or impair our servers or networks
• Not attempt to access other users' accounts or data
• Report any security vulnerabilities or bugs to support@peppai.com
• Accept responsibility for all activities conducted through your account
• Keep your account information secure and confidential

9.1 Disclaimer of warranties

THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. PEPP AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• TITLE
• ACCURACY OR COMPLETENESS OF CONTENT

9.2 Limitation of damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PEPP AI SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL
• BUSINESS INTERRUPTION OR LOSS OF BUSINESS OPPORTUNITY
• DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE PLATFORM
• ERRORS, OMISSIONS, OR INACCURACIES IN CONTENT

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE PLATFORM IS TO STOP USING IT.

9.3 Liability cap

PEPP AI'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, AND CAUSES OF ACTION SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO PEPP AI IN THE 12 MONTHS PRECEDING THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENTS, LIABILITY SHALL NOT EXCEED ₹100.

You agree to indemnify, defend, and hold harmless PEPP AI, its owners, operators, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from or related to:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights
• Your User Content
• Your conduct on the Platform

11.1 Termination by PEPP AI

We may immediately suspend or terminate your account and access to the Platform, without notice, if:

• You violate any material provision of these Terms
• You engage in illegal activity or fraud
• You harass, threaten, or abuse other users
• We believe your account poses a security risk
• You attempt unauthorized access to our systems

11.2 Termination with notice

For other violations not listed above, we will provide reasonable notice (typically 30 days) and an opportunity to cure the violation before termination.

11.3 Effect of termination

Upon termination:

• Your access to the Platform will be immediately revoked
• Any paid subscription fees for unused portions of the month will not be refunded
• Your User Content may be permanently deleted after a reasonable notice period
• Clauses that are intended to survive termination (limitation of liability, indemnification, IP rights) shall remain in effect

The Platform integrates with third-party services, including but not limited to Razorpay for payment processing. Your use of third-party services is governed by their respective terms of service and privacy policies. PEPP AI is not responsible for:

• The availability, accuracy, or quality of third-party services
• Loss or damage arising from your use of third-party services
• Data handling practices of third-party service providers

13.1 Data collection

PEPP AI collects minimal user data necessary for Platform operation, including:

• Account registration information (name, email address, mobile number)
• Payment information (processed through Razorpay or similar platform, not stored by us)
• Quiz progress and performance data
• IP address and device information

13.2 Data use

Collected data is used to:

• Provide and improve Platform services
• Process payments and support billing
• Communicate important notices and support
• Analyze usage patterns and enhance user experience
• Comply with legal obligations

13.3 Data protection

We implement reasonable security measures to protect your information. However, no method of data transmission over the internet is entirely secure. You use the Platform at your own risk regarding data security.

Educational content provided by PEPP AI is for learning and self-assessment purposes only. PEPP AI does not provide professional advice of any kind, including but not limited to:

• Financial or investment advice
• Medical or health advice
• Legal advice
• Career or academic counseling

Content should not be relied upon as a substitute for professional advice. Users are encouraged to consult qualified professionals for advice relevant to their specific situation.

16.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

16.2 Jurisdiction and venue

You irrevocably consent to the exclusive jurisdiction of the courts located in Bengaluru, India for any disputes arising from or related to these Terms or your use of the Platform.

16.3 Dispute resolution

Before initiating legal proceedings, you agree to attempt good-faith resolution through direct communication with PEPP AI at support@peppai.com. If the dispute cannot be resolved through good-faith negotiation, either party may pursue legal remedies available under applicable law.

PEPP AI may modify these Terms at any time. We will provide notice of material changes via:

• Email to the address associated with your account
• Prominent posting on the Platform
• Other reasonable means

Your continued use of the Platform following notice of changes constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Platform.

18.1 Entire agreement

These Terms constitute the entire agreement between you and PEPP AI regarding your use of the Platform and supersede all prior agreements, understandings, and negotiations.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.3 Waiver

The failure of PEPP AI to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

18.4 Assignment

These Terms cannot be assigned or transferred by you without our written consent. Any attempt to assign these Terms without consent is void.

18.5 Headings

The section headings in these Terms are for convenience only and do not affect the interpretation of the Terms.

18.6 Survival

Sections that by their nature are intended to survive termination (including Limitation of Liability, Indemnification, Intellectual Property, Dispute Resolution, and Governing Law) shall remain in effect after termination or expiration of these Terms.
